Privacy Policy & Website Terms
This page sets out how Miami Rowing & Watersports Center, Inc. (d/b/a Miami Rowing Club) handles personal information collected through this website and its online forms (Part I), and the terms and limitation of liability that apply to use of the website (Part II).
Part I Privacy Policy
1. Who We Are
Miami Rowing & Watersports Center, Inc., doing business as the Miami Rowing Club (“the Club,” “MRC,” “MRWC,” “we,” “us,” or “our”), is a Florida not-for-profit corporation and a tax-exempt organization under Internal Revenue Code § 501(c)(3). 2. Scope and Governing Law
This Policy applies to personal information collected through our website, online forms, email, text messages we send, and other electronic communications that link to this Policy. It does not automatically apply to information collected only in person at the boathouse, except to the extent that information is later entered into the same systems used to process website forms.
We operate in Florida. We design this Policy to be consistent with:
- The Florida Deceptive and Unfair Trade Practices Act, Fla. Stat. § 501.201 et seq. (accurate statements about how we handle data);
- The Florida Information Protection Act, Fla. Stat. § 501.171 (reasonable security measures and breach notice to Florida residents);
- The Children’s Online Privacy Protection Act, 15 U.S.C. §§ 6501–6506, and the FTC’s COPPA Rule (information from children under 13);
- Applicable IRS rules for 501(c)(3) donor records; and
- Industry practice among U.S. rowing organizations, including USRowing affiliation requirements.
The Florida Digital Bill of Rights, Fla. Stat. § 501.701 et seq., generally does not apply to 501(c)(3) organizations and is limited to very large for-profit controllers. We nonetheless follow the practical standards of notice, purpose limitation, data minimization, and security described below.
By using the website or submitting a form, you acknowledge this Policy. If you do not agree, do not submit personal information through the site.
3. Personal Information We Collect
The categories we collect depend on the form you complete and the program you join. We collect only what is reasonably necessary for club operations, athlete safety, membership administration, fundraising, and legal compliance. Information is collected through miamirowing.org (including the contact page), PDF applications posted on the Registration & Forms page that are dropped at the boathouse or emailed to office.miamirowing@gmail.com, GoMotion online team registration, the Square merchandise shop, event and donation pages, and email or telephone follow-up.
A. Information you provide through website forms
- Identity and contact information: name, preferred name, date of birth, age, gender or gender identity (if requested for boat assignment or racing categories), mailing address, email address, mobile and home telephone numbers.
- Membership and program information: membership category, program (youth, high school, learn-to-row, masters, recreational, adaptive), rowing experience, USRowing number, club affiliation, school, graduation year.
- Parent or guardian information for junior athletes: parent/guardian name, relationship, contact details, and consent records.
- Emergency contacts: name, relationship, and telephone number of one or more emergency contacts.
- Health and safety information reasonably needed for participation: swim ability or swim-test attestation; allergies; medications; relevant medical conditions, injuries, or disabilities; physician clearance when required; insurance information if requested for emergencies. This information is treated as sensitive and is used only for safety, accommodations, and emergency response.
- Payment and donation information: billing name and address, donation amount, membership dues, program fees, and last-four digits or tokenized payment confirmation. Full credit-card numbers are collected by our payment processor, not stored by the Club on Club servers.
- Waiver and acknowledgment records: electronic signatures, IP address or timestamp associated with a signed form, and the text of the waiver version signed.
- Communications: messages you send through contact forms, emails, and any attachments you choose to upload.
- Volunteer, coach, and employment-related information if you apply to work or volunteer (background-check authorization, SafeSport training status, references).
- Photo and media preferences: whether you grant or withhold permission for the Club to use photographs or video of a participant.
B. Information collected automatically
- Device and log data: IP address, browser type, operating system, referring URL, pages viewed, date and time of visit, and approximate location derived from IP address.
- Cookies and similar technologies used for session management, security, form completion, and aggregated analytics.
C. Information from third parties
We may receive information from USRowing or other governing bodies when you affiliate with the Club; from payment processors confirming a completed transaction; from background-check vendors for coaches and certain volunteers; and from publicly available sources used to verify membership or competition eligibility.
4. How We Use Personal Information
We use personal information for the following purposes:
- To process membership applications, program registration, boat storage, guest rows, learn-to-row classes, camps, and event entries submitted through our website.
- To communicate about schedules, cancellations, weather, safety notices, dues, and Club business.
- To protect athlete and visitor safety, including emergency response and sharing limited medical or contact information with first responders when reasonably necessary.
- To administer racing: entries, weigh-ins, boatings, and required submissions to USRowing, the Florida Scholastic Rowing Association, or host regattas.
- To process payments, issue receipts, and maintain donor and member financial records required of a 501(c)(3) organization.
- To comply with SafeSport, background-screening, insurance, and child-protection obligations.
- To send newsletters and fundraising appeals. You may unsubscribe from promotional email at any time. We will still send transactional messages (receipts, safety alerts, membership status).
- To improve the website, detect fraud or abuse, and maintain security.
- To comply with law, respond to lawful requests, enforce Club rules, and protect the rights, property, and safety of the Club, members, and the public.
We do not sell personal information. We do not rent member or donor lists. We do not use sensitive health information for advertising.
5. How We Share Personal Information
We share personal information only as needed to operate the Club:
- Service providers. Website hosts; Google (including Gmail used at office.miamirowing@gmail.com); GoMotion registration; Square for shop and card payments; cloud storage and accounting tools; and other processors that are limited to using the data to serve the Club. Regatta hosts such as RegattaCentral may receive entry data for the Miami International Regatta and other races.
- Sport governing bodies and event hosts. USRowing, regional or state rowing associations, and regatta organizers, when required for membership, insurance, SafeSport, or competition entry.
- Coaches, launch drivers, and designated volunteers. Limited roster, emergency-contact, and relevant medical information needed to run a practice or event safely.
- Professional advisors. Attorneys, accountants, insurers, and auditors under confidentiality obligations.
- Legal and safety disclosures. When required by law, court order, or to address a genuine emergency, suspected child abuse, or imminent risk of harm.
- Organizational change. If the Club merges, transfers programs, or dissolves, member records may transfer to a successor 501(c)(3) with a comparable mission, subject to this Policy.
We do not share personal information with unaffiliated third parties for their independent marketing.
6. Children, Youth Athletes, and COPPA
Our website and online forms are directed to adults — members 18 and older, and parents or legal guardians of junior athletes. We do not knowingly allow a child under 13 to create an account or submit personal information directly through the website.
As a youth rowing organization, we do collect information about participants under 18, including athletes under 13, from a parent or legal guardian as part of registration, with parental consent. Health, emergency-contact, and school information about a minor is collected only for program administration and safety.
If you believe we have received personal information directly from a child under 13 without verifiable parental consent, contact office.miamirowing@gmail.com. We will delete the information or obtain proper consent promptly.
Parents and guardians may review, correct, or request deletion of their child’s information, subject to records we must keep for safety, insurance, or legal reasons.
7. Cookies, Analytics, and Do Not Track
The website may use session cookies required to submit forms securely and optional analytics cookies (for example, Google Analytics) to understand aggregate traffic. You may block cookies in your browser; some forms may then fail to submit. We do not currently respond to browser Do Not Track signals because there is no uniform standard. We do not use the website to serve third-party behavioral advertising.
8. Payments and Donations
Online dues and donations are processed by third-party payment processors. Those processors receive the payment-card data needed to complete the transaction and are responsible for PCI-compliant handling of that data. The Club receives confirmation of payment, the payer’s name, contact information, amount, and purpose (membership, program fee, or donation).
Contributions to the Club are generally tax-deductible to the extent allowed by law. A donation receipt is not legal or tax advice. No goods or services are provided in exchange for a pure donation unless we state otherwise on the giving page.
9. Data Security
We use reasonable administrative, technical, and physical safeguards appropriate to a community athletic nonprofit. These may include HTTPS encryption in transit, restricted staff and volunteer access, password-protected systems, and vendor selection that includes security expectations.
No method of internet transmission or electronic storage is completely secure. You submit information through the website at your own risk. You are responsible for keeping any login credentials confidential.
Under the Florida Information Protection Act, Fla. Stat. § 501.171, if a breach of security affecting personal information of a Florida resident occurs and misuse has occurred or is reasonably likely, we will notify affected individuals as expeditiously as practicable and no later than 30 days after determination of the breach, unless a lawful delay applies. If 500 or more Florida residents are affected, we will also notify the Florida Department of Legal Affairs within that statutory period.
10. How Long We Keep Information
We keep personal information only as long as needed for the purposes collected, and longer when law, insurance, or sound nonprofit recordkeeping requires it. Typical periods:
- Active membership and program files: for the duration of participation plus a reasonable period thereafter.
- Waiver, incident, and medical-release records: at least through the applicable statute of limitations and any longer period required by the Club’s insurer.
- Donation and financial records: generally seven years, consistent with IRS nonprofit record-retention practice.
- Youth athlete files: as needed for safety history and as required by SafeSport or insurance guidelines.
- Website logs: a short operational period unless needed for security investigation.
When retention expires, we delete or de-identify information in a commercially reasonable manner.
11. Your Choices and Requests
Subject to legal limits, you may:
- Request access to the personal information we hold about you or your minor child.
- Request correction of inaccurate information.
- Request deletion, except where we must retain the record for safety, insurance, tax, dispute, or legal-compliance reasons.
- Unsubscribe from promotional email using the link in the message or by writing office.miamirowing@gmail.com.
- Withdraw a photo-release preference going forward (already published materials may not be recalled from third parties).
We will respond within a reasonable time. We may need to verify your identity before completing a request. We will not discriminate against you for exercising these choices.
12. Third-Party Websites and Embedded Tools
The website may link to USRowing, regatta hosts, maps, social media, or payment pages. Those sites have their own policies. We are not responsible for their content or privacy practices. Information you submit on a third-party form is governed by that third party.
13. International Visitors
The website is hosted in the United States and is intended for use in the United States. If you access it from another country, you consent to transfer of your information to Florida and to processing under U.S. and Florida law.
14. Changes to This Privacy Policy
We may update this Policy. The “Last Updated” date will change when we do. Material changes will be posted on the website. Continued use of the website after the effective date of a revision constitutes acceptance of the revised Policy for information collected thereafter.

Part II Website Limitation of Liability Statement
16. Acceptance
By accessing https://miamirowing.org, submitting any online form, or clicking an acknowledgment box associated with this Statement, you agree to this Limitation of Liability Statement. If you are submitting information on behalf of a minor, you represent that you are the minor’s parent or legal guardian and that you have authority to bind yourself and, to the fullest extent permitted by Florida law, the minor to this Statement.
17. Informational Nature of the Website
The website is provided as a convenience for information, registration, donations, and communication. Program schedules, fees, coach assignments, launch times, and facility descriptions may change because of weather, water conditions, staffing, City of Miami or other landlord requirements, or safety decisions. We try to keep information accurate but do not warrant that any page is complete, current, or error-free.
18. No Professional Advice
Nothing on the website is medical, legal, tax, coaching, or fitness advice. Rowing and watersports involve physical exertion. You should consult a physician before beginning or continuing a training program. Tax-deductibility language on a donation page is a general statement, not personal tax advice.
19. Assumption of Risk — Website and Electronic Forms
You understand and agree that:
- Transmission of information over the internet is not guaranteed to be secure or uninterrupted.
- Forms may fail, duplicate, or be delayed. It is your responsibility to confirm that the Club received a registration, payment, or waiver before participating.
- Submitting a form does not, by itself, create a right to participate. The Club may decline, postpone, or condition participation for safety, capacity, outstanding balances, incomplete waivers, or eligibility reasons.
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, YOU ASSUME THE RISK OF LOSS ARISING FROM YOUR USE OF THE WEBSITE AND FROM ELECTRONIC TRANSMISSION OF FORMS AND PAYMENTS.
20. Disclaimer of Warranties
THE WEBSITE, ALL CONTENT, AND ALL ONLINE FORMS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE CLUB DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow disclaimer of certain implied warranties. If those rules apply to you and cannot be waived, the disclaimer applies to the maximum extent permitted.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, Miami Rowing & Watersports Center, Inc., AND ITS OFFICERS, DIRECTORS, TRUSTEES, EMPLOYEES, COACHES, VOLUNTEERS, AGENTS, MEMBERS ACTING IN AN OFFICIAL CAPACITY, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
- (a) your access to or use of, or inability to access or use, the website or any form;
- (b) any error, omission, interruption, deletion, defect, delay, or failure of the website or a third-party platform;
- (c) unauthorized access to or alteration of your transmissions or data;
- (d) statements or conduct of any third party on or through the website; or
- (e) any other matter relating to the website or electronic collection of information.
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, THE TOTAL LIABILITY OF THE RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF THE WEBSITE OR THE ELECTRONIC COLLECTION OF INFORMATION SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID TO THE CLUB THROUGH THE WEBSITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (ii) ONE HUNDRED DOLLARS (US $100).
This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if a Released Party has been advised of the possibility of such damages, and even if a limited remedy fails of its essential purpose.
22. What This Statement Does Not Waive
Nothing in this Statement is intended to exclude or limit liability for:
- Gross negligence, willful or wanton misconduct, or intentional torts, to the extent such liability cannot be limited under Florida law;
- Fraud or fraudulent inducement;
- Liability that a statute makes unwaivable; or
- Claims that Florida law does not permit a parent to waive on behalf of a minor, to the extent a court of competent jurisdiction so holds.
Florida courts generally enforce clearly written recreational and website limitations against adults who accept them. Limitations involving minors are construed more narrowly. The Club still requires a separate, signed participation waiver before on-water activity.
23. On-Water and Facility Activity — Separate Waiver Required
Rowing, coxing, launching, trailering, erging, swimming tests, and presence on docks, ramps, launches, and storage bays involve inherent risks, including collision, capsize, drowning, hypothermia, heat illness, overuse injury, and equipment failure. Those risks are addressed in the Club’s athletic waiver, USRowing waiver, and related releases — not in this website statement.
Completing a website form does not permit you or your child to row until all required waivers and safety attestations are signed and the Club has confirmed eligibility. If there is any conflict between this website statement and a signed participation waiver, the signed participation waiver controls for on-water and facility activity, and this statement controls for website use.
24. User Responsibilities and Indemnification
You agree that information you submit is true, complete, and current. You will not submit another person’s information except as a parent or guardian of a minor athlete, or with that person’s authorization. You will not upload malware, scrape the site, or interfere with its operation.
To the fullest extent permitted by Florida law, you agree to indemnify, defend, and hold harmless the Released Parties from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the website; (b) your breach of this Statement or the Privacy Policy; (c) information you submit that is false or unauthorized; or (d) your violation of law. This indemnity does not apply to the extent a claim is caused by a Released Party’s gross negligence or willful misconduct.
25. Volunteer and Nonprofit Status
The Club is a 501(c)(3) public charity. Many coaches, officers, and launch drivers serve as volunteers. The federal Volunteer Protection Act, 42 U.S.C. § 14501 et seq., and applicable Florida volunteer-protection principles may limit personal liability of volunteers acting within the scope of their responsibilities. Nothing in this Statement waives a protection those laws provide.
26. Third-Party Platforms
If a form is hosted on a third-party platform, that platform’s terms also apply. The Club is not liable for outages, data-handling errors, or security incidents originating solely from a platform we do not control, except to the extent Florida law imposes a non-delegable duty or we have independent negligence. FIPA and contract duties regarding vendors still apply to the Club as described in the Privacy Policy.
27. Governing Law, Venue, and Dispute Resolution
This Privacy Policy and this Limitation of Liability Statement are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
You agree that exclusive venue for any dispute arising out of the website, online forms, this Policy, or this Statement shall lie in the state courts of Miami-Dade County, Florida, or in the United States District Court for the Southern District of Florida, Miami Division, and you consent to personal jurisdiction there.
You and the Club waive any right to a jury trial to the extent such waiver is enforceable under Florida law. You and the Club also agree that any dispute will be brought only in an individual capacity and not as a class, collective, or representative action, to the extent that waiver is enforceable. If a court finds the class waiver unenforceable, that clause will be severed and the remainder will continue in effect.
Before filing a lawsuit arising from website use or form processing, you agree to provide written notice to office.miamirowing@gmail.com and to Miami Rowing & Watersports Center, Inc., 3692 Grand Avenue, Suite 332, Miami, Florida 33133, and to allow thirty (30) days for good-faith resolution.
28. Severability and Entire Statement
If any provision of this Policy or Statement is held invalid or unenforceable, the remaining provisions will continue in full force. This document, together with any clickwrap acknowledgment on a specific form and any signed participation waiver, is the entire website-privacy and website-liability agreement between you and the Club. It may be modified only by a posting on the website or a writing signed by an authorized officer of the Club.
